P.L. 1983, ch.446 expanded the definition of “lobbyist” under the Lobbyist Disclosure Law to include employees of the Maine Community College System (along with other state-funded institutions of higher education, and boards and commissions). The law requires the system to register with the Commission on Governmental Ethics and Election Practices and to submit a monthly and annual report on lobbying activities. President Fitzsimmons and other representatives of the Maine Community College System are registered for the MCCS.

The system is required to report on lobbying activity when an individual “expends an amount of time in excess of eight hours in any calendar month lobbying.” Lobbying is defined as communicating directly with any individual in the legislature for the purpose of influencing any legislative action on specific bills or with the Governor for the purpose of influencing approval of or a veto of a specific legislative action. The lobbyist definition also includes preparation of testimony for informational materials relating to legislation. However, this applies only if the person preparing such material is also conducting the actual lobbying.

Should any NMCC employee accrue, on behalf of NMCC/MCCS, more than eight hours in any calendar month lobbying for legislative action, please contact the NMCC President’s office for the reporting form.
